TERMSPRIVACY POLICYCODE OF CONDUCT

§ 1 SCOPE OF APPLICATION, PERSONAL DATA, PROTECTION OF PRIVACY

(1) This privacy policy solely applies to the websites of Professional360 GmbH, Leipziger Strasse 48, 10117 Berlin – hereinafter “Panono” – under www.panono.com. Hereby all visitors and users of www.panono.com – hereinafter “user” – are informed about the handling of data, in particular the extent and purpose of the elicitation of personal and other data.

(2) Personal data is information that helps to determine any natural person, thus, information that can be traced back to a certain natural person. These include but are not limited to name, email address, postal address or telephone number.

(3) Panono is obliged to protect the privacy of all users of www.panono.com. Personal data will only be collected, used and shared, if it is legally permitted or if the user has agreed to the use of data. Panono assures that personal data will only be processed and used in accordance with the data protection laws of Germany, i.a. the Bundesdatenschutzgesetz (BDSG), the Telemediengesetz (TMG) and solely for the purposes defined under § 2 and the following paragraphs.

§ 2 COLLECTION OF DATA WHEN VISITING WWW.PANONO.COM

(1) In general, it is not necessary to provide personal data in order to use the websites and the online services (hereinafter “services”) offered by Panono under www.panono.com. Merely access data without any personal reference are being stored such as

  • the name of your internet access provider,
  • the internet site the user is coming from and
  • the names of the requested files and their request date.

This data is only collected in order to enable the use of the sites of www.panono.com, to guarantee system security and to improve Panono’s offerings. The data collected does not allow any conclusion to be drawn to individual persons.

(2) Furthermore, Panono uses cookies (§ 5) and external web analysis services (§ 8) as well as social media plugins (§ 8) during the visit of www.panono.com. It may occur that third party content such as videos are embedded on www.panono.com. For access of this content, it is necessary to disclose the user’s IP address to the third party provider.

(3) Personal data is only collected, if the user voluntarily shares it with Panono. Personal data is collected by Panono in the course of orders of goods (§ 3) and in the context of registration for the services of Panono (§ 4); they are stored and processed on servers of Panono that are located within the European Union. For any collection of personal data by payment service operators, only those companies offering the particular payment service are responsible (§ 7).

(4) The user may revoke his consent to the storage, processing and use of collected data at any time, respectively, object to the use for commercial advertisement (§ 9).

§ 3 COLLECTION OF DATA DURING ORDERS OF GOODS, EXTENT AND PURPOSE OF COLLECTING DATA, CONSENT

(1) Collection of personal data in the context of orders of goods

In the context of orders of goods by the user, Panono collects, stores and processes the following personal data required for processing the contracts:

  • name
  • first name
  • street
  • house number
  • city
  • country
  • email address
  • data of chosen payment method

By clicking the button “place your order” consent is given to the collection of personal data in the context of orders of goods and their usage described in the following subsections (2) and (3).

Further personal data may be collected by the payment processor chosen by the user (§ 7).

(2) Usage and processing of personal data for the purpose of the purchase processing

Panono collects, stores and processes all personal data collected in the context of orders of goods for the purpose of purchase processing, including any potential subsequent warranties, for Panono’s services, for the technical administration as well as for Panono’s own marketing purposes. As far as it is necessary for the purpose of processing the purchase or if the user has explicitly agreed to it, personal data will be shared or otherwise transferred to third parties. For example, in the context of handling the orders certain service providers (logisticians, carriers, banks) chosen by Panono shall receive all necessary data for handling the order. The service providers chosen by Panono must exclusively use all shared personal data in order to fulfil their task. Any further usage is not permitted and none of the service providers will exceed their authority.

(3) Usage and processing of personal data for marketing purposes and for product recommendations via email

Beyond processing the transaction, Panono uses the collected and stored personal data in order to communicate with the user regarding his orders, certain products or marketing measures and in order to recommend products that the user might be interested in.

The user regularly receives product recommendations via email. This service will be operated regardless of the newsletter service. By this means, the user shall get access to information about Panono products that may interest him on the basis of his last purchase.

§ 4 COLLECTION OF DATA IN THE CONTEXT OF THE PROVIDED SERVICES, EXTENT AND PURPOSE OF COLLECTION, CONSENT

(1) Collection of personal data during registration and use

During the process of registration for the use of the provided services on www.panono.com, Panono alternatively stores and processes the following personal data:

  • email address
  • login data of the user’s facebook account
  • login data of the user’s twitter account.

Beyond registration, Panono does not collect any personal data during the use of the service as far as the user does not provide them voluntarily.

The user gives his consent to the collection of personal data within the scope of the registration and to the use described as followed in (2) – (4) by clicking the button “Sign in” at the end of the registration process.

(2) Use and processing of personal data

Personal data are collected, stored and processed for the purpose of providing Panono’s services, for inherent services, for the technical administration, especially for registration and in order to identify the user in the context of the login, for the allocation of the user’s account as well as for marketing purposes. Personal data will only be transferred or otherwise transmitted to any third party, if it is necessary for the purpose of providing services or billing or if the user previously has explicitly given his consent.

Within the scope of registration and login via Facebook and Twitter, Panono transfers the following login data to the following service providers:

  • Twitter: Twitter Inc. 1355 Market Street, Suite 900, San Francisco, CA 94103, USA
  • Facebook outside of Canada and Europe: Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Irland
  • Facebook USA and Canada: Facebook Inc. 471 Emerson St., Palo Alto, CA 94301-160, USA
  • Google+: Google Inc. („Google“), Amphitheatre Parkway, Mountain View, CA 94043, USA

(3) Storage of panoramas and files during usage

Beyond that, Panono stores and processes data voluntarily uploaded by the user during the use of Panono’s services, such as

  • panoramas
  • other files
  • other data connected to these panoramas or files, for example geographic coordinates of the panoramas taken.

The panoramas and other files will be stored on Panono’s servers (§ 2 III). Any transfer or other transmission to any third party will only be made by the user himself, for example by sharing or posting in social media platforms (§ 8). Panono has no influence on the data processing by those social media platform providers.

(4) Usage and processing of personal data for marketing purposes and for product recommendations via email

Beyond the purpose of providing services, Panono uses the collected and stored personal data in order to communicate with the user about his orders, certain products or marketing measures and in order to recommend products that the user may be interested in.

§ 5 COOKIES, STORAGE, CONSENT

(1) Cookies without reference to online advertisement

Panono places so-called cookies that are necessary for Panono’s services on www.panono.com. Cookies are small text files that are placed on your computer and which your browser stores. Cookies do not contain personal data. Beside others they serve the purpose to verify the user’s authority for the request of the desired article or for online services, and to store the user’s input on our website (login session cookie, shopping basket cookie, security cookie). After closing your web browser, most of the cookies Panono uses will be deleted from the user’s hard disk (“session-cookies”). The so-called „permanent cookies“ remain on the user’s computer and enable Panono to identify him on his next visit.

(2) Tracking Cookies, Onsite Targeting, Retargeting

Beyond that, Panono places so-called “Cookies” or code snippets in order to create online advertisements adjusted to the user and his interests for so-called onsite-targeting and re-targeting. In this process, available data will be used, such as

  • information about the computer and the connection to the internet,
  • operating system and platform,
  • order history, service history,
  • date and time of the visit on www.panono.com, and
  • products the user viewed.

a. Onsite-Targeting

Panono uses data stored by placing cookies to create advertisements adjusted to the user and his interests (so-called Onsite-Targeting). Panono uses these information solely in pseudomized form to improve its internet service provided as well as to send individual advertisement interesting and necessary for the user.

b. Re-Targeting

Panono cooperates with external partners to place and optimize inherent or external insertions of advertisements. Panono uses data stored by placing cookies to create advertisements on websites of third parties adjusted to the user and his interests (so-called Re-Targeting). This form of advertising is made entirely pseudonymous. No personal data will be stored or stored date by placing cookies will be joined with personal data.

c. Consent

The user explicitly agrees to the usage of cookies by Panono and collection, storage and use of usage data for marketing purposes of onsite- and re-targeting described under (2). (3) Prevention from Cookies

The user has the opportunity of preventing the storage of cookies on his computer by making appropriate changes to his browser settings which however may limit the functionality of the offer. Users can deactivate the storage of cookies on their browser, limit the storage to only certain websites or make setting so that the browser will notify them before a cookie is stored. Users can delete cookies from their hard disk at any time by using the data protection functions of their browser. In this case, the functionality and user-friendliness of www.panono.com could be limited.

§ 6 NEWSLETTER

(1) For its newsletter service Panono uses the so-called Double Opt-In method, so that the user receives a newsletter via email only after explicitly confirming the activation of the newsletter service. The service is activated only after clicking the link sent to the user in the confirmation email after his registration for the newsletter service.

(2) For deregistration from the newsletter a notification in writing to the contact data as stated in § 9 suffices. Besides that it is possible to unsubscribe from the recipients list by clicking the deregistration link every newsletter contains.

§ 7 COLLECTION OF DATA FOR PAYMENT PROCESSING

For payment processing Panono uses the following external payment processors: payment via PayPal: PayPal (Europe) S.à.r.l. et Cie, S.C.A. 22-24 Boulevard Royal L-2449 Luxembourg. Payment via credit card and debit: Stripe, Inc., 3180 18th St, San Francisco, CA 94110, USA. Panono hereby emphasizes that the chosen payment processor may collect, process and use further personal data. Insofar Panono is not responsible; the terms of use and privacy policies of the aforesaid payment service providers shall apply exclusively.

§ 8 EXTERNAL WEB ANALYSIS SERVICES / SOCIAL PLUGINS

(1) Google Analytics

For its website www.panono.com Panono uses Google Analytics, a web analysis service of Google Inc., 1600 Amphitheatre Parkway, Mountain View CA 94043, USA (in the following „Google“).

Google Analytics uses „cookies“ (§ 5) that allow the analysis of the user’s use of the website. Information about your use of this website generated by the cookie (including your IP address) will be transferred to and saved on any server of Google in the US.

Following the information given by Google, these information are only used in order to evaluate your use of the website, to compile reports on the website activity for the website providers and to provide further services related to the use of the website and the internet. If necessary, Google may as well transfer those information to third parties, if it is prescribed by law or if third parties process those data on behalf of Google. Not in any case, Google will relate your IP address to other data of Google. You can prevent the installation of cookies by making appropriate changes to your browser settings. In that case, Panono emphasizes that you may not be able to use all features of this website to the full extent.

Panono has integrated an embedded program (Plugin) on www.panono.com of the third party provider Facebook, Inc., 1601 South California Avenue, Palo Alto, CA 94304, USA. The Facebook-plugins may be recognized by the Facebook-logo or the “like button” (“like) on our website.

Thereby Facebook receives the information that the IP address at this time allocated to your computer or to your internet connection has visited the website www.panono.com.

In this way, Facebook can allocate the visit of these websites to your user account. Panono does not have any knowledge of the content of the transferred data as well as its usage by Facebook. (4) Twitter

Panono uses the button oft he third party provider Twitter. These buttons are offered by Twitter Inc., 795 Folsom St., Suite 600, San Francisco, CA 94107, USA.

By means of the function of Twitter, it is possible to share a contribution on Twitter or to any provider on Twitter. In this process, the website visited by the user is connected with his Twitter account and shown to other users. There are also data transferred to Twitter. The content of the Twitter button is directly transferred to the user’s browser by Twitter. Therefore, Panono has no impact on the extent of data collected by Twitter plug-ins and informs the user according to its state of knowledge. Thus only the user’s IP address and the URL of the website are transferred when the button is clicked, but they are not used for any other purposes than the display of the button.

§ 9 WITHDRAWAL OF GIVEN CONSENT, WITHDRAWAL REGARDING ADVERTISING, USER'S RIGHTS

(1) The user may entirely or partially revoke his given consent for the future to the collection, storage, processing and usage of personal data or usage data i.e. for marketing purposes or object to the receiving of advertisement. Revocation or objections shall be made by mailing an informal notification to Professional360 GmbH, Französische Straße 9, 10117 Berlin or by sending an email to datenschutz@panono.com.

(2) Regarding his stored personal data, the user has stated by law the rights of information, correction and deletion. These rights shall be exercised by given informal notification via email to datenschutz@panono.com or via air mail to Professional360 GmbH, Französische Straße 9, 10117 Berlin.
